This End User License Agreement (EULA) is a legal agreement between you (either an individual, corporation, public organization, or a company whatsoever) and eNewsDog.com for the software product accompanying this EULA, which includes computer software and may include associated media and printed materials, database scripts and schema, as well as on-line or electronic documentation. By licensing and using the software product, you agree to be bound by the terms of this EULA.

This is a one license pack which means that you can use, access, run, or otherwise interact with just one COPY of this SOFTWARE PRODUCT. The software product is licensed, not sold. eNewsDog.com sells the license to use the software product, not the software product itself. eNewsDog.com will offer FREE email support and access to free updates of the software product (if and when such updates are published) as long as your account remains current.  To remain a current customer in good standing, you must use your account once per month to send paid newsletters.  Any accounts not used for 60 days are subject to cancellation and all subscriber and newsletter data will be removed.

The software product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.  eNewsDog.com may terminate your rights under this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you forfeit all rights and access to software and data.

You shall use this software only in compliance with this Agreement, the federal CAN-SPAM Act of 2003 and regulations thereunder and all other applicable U.S., state, local and international laws (including but not limited to policies and laws related to spamming, privacy, obscenity, or defamation, copyright and trademark infringement and child protective email address registry laws).  You may send emails only to those addresses where you have pre-established a relationship.

eNewsDog.com expressly disclaims any warranty for the software product. The software product and any related documentation is provided "as is" without warranty of any kind. eNewsDog.com does not warrant that the functions of the software product will meet your requirements or that operation of the software product will be uninterrupted or error free. The entire risk arising out of use or performance of the software product remains with you.

To the maximum extent permitted by applicable law, in no event shall eNewsDog.com or its affiliates or its resellers or its associates be liable for any special, incidental, direct or indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software product.
